Oklahoma can't get monetary damages in poultry lawsuit

The Oklahoma attorney general’s attempts to collect more than $600 million fizzled when the U.S. district court judge ruled that the state didn’t name the Cherokee Nation as a plaintiff. The Illinois River watershed area that is in dispute is part of the area set aside by the U.S. government to the Cherokee Nation, and Oklahoma doesn’t have the authority to seek damages on the nation’s behalf.

Oklahoma can still pursue the lawsuit to force the poultry companies named in the lawsuit to stop dumping what the state claims are excessive amounts of poultry waste on farmlands in the area.
